These terms govern the use of our services in the areas of marketing, branding, and digital communication. Please read them carefully.
These terms of use apply to all services of Pencilbox Marketing Kreativagentur, including consulting, conception, design, and implementation of marketing and branding measures. The contract is concluded upon written acceptance of our offer.
The client ensures that all provided content, brands, and materials are free from third-party rights and do not violate any legal regulations. They are obliged to provide us with all necessary information and decisions in a timely manner.
The exact scope of services is defined in the respective offer or contract. Subsequent changes or additions require a written agreement. We reserve the right to charge for partial services if the client requests changes.
We are only liable for damages caused by gross negligence or intent. Liability for slight negligence is excluded, unless it involves injury to life, body, or health. We assume no liability for indirect damages or lost profits.
All concepts, drafts, texts, graphics, and other content created by us remain our property until full payment. Upon full payment, the client receives a simple, non-transferable right of use for the agreed purpose.
The contract runs for the duration specified in the offer. Ordinary termination is possible with a notice period of four weeks to the end of the month. In the event of serious breaches of duty, the contract may be terminated without notice. Services already rendered must be compensated in any case.
Austrian law applies. The place of jurisdiction is the registered office of the agency. Should a provision be invalid, the remainder of the contract remains valid.
